1. The present petition has been filed for restoration of a writ petition bearing C.W.J.C. No.4786 of 2015, which has stood dismissed on account of non-prosecution, by an order dated 31.07.2024.

2. The learned counsel for the petitioner submits that the main counsel, who had filed the aforesaid writ petition, although the present counsel was also a signatory to the vakalatnama of the said case, has left practice after the Covid-19 pandemic, hence the case could not be marked on the day the same was listed, resulting in dismissal of the aforesaid writ petition for non-prosecution, hence, a sympathetic view be taken

Patna High Court MJC No.4364 of 2024(2) dt.10-01-2025 2/2 and the aforesaid writ petition be restored to its original file.

3. Having regard to the submission made by the learned counsel for the petitioner as also considering the averments made in the present petition, I deem it fit and proper to restore the aforesaid writ petition bearing C.W.J.C. No. 4786 of 2015 to its original file.
