2. The present petition has been preferred for the grant of following relief(s):
"for issuance of appropriate writ/writs, direction/ directions, order/orders to the Respondents not to encroach upon the land of the petitioner-Institute, which acquired sizable
Patna High Court CWJC No.24098 of 2018(2) dt.11-11-2025 2/3 area of land for the purpose of setting up an Engineering College, in the name and style of "Royal Ashoka Institute of Management and Technology" at Bihta, Patna."

At the outset, learned counsel representing the respondents submit that lots of water has flown down the ganges inasmuch as the encroachment proceeding vide Encroachment Case No. 15 of 2018-19 initiated by the Circle Officer, Bihta, Patna came to end on 12.03.2019 which followed Encroachment Appeal No. 02 of 2019 preferred before the Collector, Patna.
4. In CWJC No. 10971 of 2019 (Buddha Education and Social Development Sansthan, Alamganj, Patna vs. the State of Bihar and Ors.), a coordinate Bench of this Court on 22.10.2019 directed the Collector, Patna to hear and decide the Appeal No. 02 of 2019.
5. The further submission is that two writ petitions vide CWJC No. 5175 of 2020 and CWJC No. 17975 of 2024 of the petitioner's Sansthan are pending before this Court and the present prayer clearly shows that it has become infructuous.
6. At this stage, learned counsel for the petitioner submits that he shall be agitating the matter in the aforesaid two petitions which are presently pending before Patna High Court.
