2. The petitioners apprehend their arrest for the offences alleged under Sections 363 and 366/34 of the Indian Penal Code, registered in connection with Goraul (Katahara O.P.) P.S.Case No. 16 of 2024.
3. According to para-19 of the case diary, the date of birth of the victim is 06.04.2002. She was major on the date of occurrence. She, in her statement under Section 183 of the BNSS, has stated that she went to Bangalore with petitioner no.1. She had physical relation with petitioner no.1 with
Patna High Court CR. MISC. No.89168 of 2024(7) dt.22-09-2025 2/2 consent. She later married to one Golu Kumar in Bangalore itself, according to Hindu rituals and customs. The victim has further stated that she has a child from Golu Kumar.
4. The victim was major on the date of occurrence. She with her consent had sexual relation with petitioner no.1, according to her statement under Section 183 of the BNSS.
5. Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Vaishali at Hajipur in connection with Goraul (Katahara O.P.) P.S.Case No. 16 of 2024, subject to the conditions as laid down under Section 438(2) Cr. P.C/482(2) of the BNSS, 2023.
