The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code and Sections 25(1-b)a and 26 of the Arms Act.

According to FIR, unknown miscreants snatched Rs.1,30,000/- from the informant besides other belongings. Submission is that the person who disclosed the name of the petitioner to the police is inimical to the petitioner. The looted article was recovered from the house of co-accused Sarfaraz Ansari. Petitioner has got no criminal antecedent. Coaccused Mumtaj Alam @ Md. Mumtaj Alam @ Mumtaz Alam having identical allegation has been allowed anticipatory bail by

Patna High Court CR. MISC. No.79138 of 2019(2) dt.04-12-2019 2/2 a coordinate Bench of this Court in Cr.Misc.No.70150 of 2019 dated 15.11.2019.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender in the court below within a period of thirty days from the date of receipt of the order, on furnishing bail bond of Rs.20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-X, Gaya in connection with Fatehpur P.S.Case No.02 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
