2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 307, 386, 120B and 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per prosecution case, specific accusation of assault is against co-accused Shivam Kumar and Kanhaiya Ram, who are alleged to have caused fire arm injury to the informant. So far as these petitioners are concerned, they are alleged to have demanded ransom of Rs. 5,00,000/- three days prior to the alleged occurrence.
4. It is submitted by learned counsel appearing on
Patna High Court CR. MISC. No.2914 of 2024(3) dt.07-03-2024 2/2 behalf of the petitioners that there is no specific accusation of overt act against these petitioners. It is next submitted that these petitioners have been made an accused in this case only because of previous dispute.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail.
6. Considering the aforesaid facts and circumstances and nature of accusation, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai, in connection with Bachhwara P.S. Case No.302 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
