2. The petitioner seeks bail in connection with NDPS Case No. 45 of 2023 arising out of Raghopur P.S. Case No. 328 of 2023 registered for the offence punishable under Sections 8(c), 21(c) and 29 of the NDPS Act.

3. As per the prosecution case, 104 grams of Brown Sugar (Heroine) has been recovered from the petitioner.

4. The petitioner is a resident of West Bengal and has been caught in the district of Vaishali along with other criminals who are also from West Bengal.

5. It has been submitted by learned counsel for the petitioner that the petitioner is in jail since 07.09.2023, the recovery is of intermittent quantity and the petitioner has clean antecedent.

6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

7. Considering the above submissions, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, NDPS, Supaul in connection with NDPS Case No. 45 of 2023 arising out of Raghopur P.S. Case No. 328 of 2023.

9. The petitioner will also mark attendance in Koliachak Police Station in the district of Maldah (West Bengal) on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.

10. Let a copy of this order be communicated to the Superintendent of Police, Maldah (West Bengal) for its compliance through FAX or e-mail forthwith.
