2. This is the second attempt on behalf of the petitioner for grant of bail in connection with Special Trial No. 130 of 2021 arising out of Patliputra P.S. Case No. 466 of 2021 registered for the offence under Sections 20(b)(ii)(c) of the N.D.P.S. Act read with Sections 25(1-b)a, 26 and 35 of the Arms Act.

3. Earlier the bail application of the petitioner has been rejected vide order dated 22.05.2023 passed in Cr. Misc. No. 66638 of 2022.

4. The allegation against the petitioner is that 23.8 kg of Ganja has been recovered from the car in which the petitioner

5. Learned counsel for the petitioner submits that the petitioner is in custody since 16.09.2021. In the trial, no witness has turned up.

6. Considering the period of custody and the delay in trial, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Court (N.D.P.S.) No. 2, Patna/concerned Court in connection with Patliputra P.S. Case No. 466 of 2021.

8. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed in the trial. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioner.
