====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 06-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Barachatti P.S. Case No. 92 of 2018, instituted for the offence under Sections 147, 148, 149, 212, 384, 386, 401, 427, 435 of the Indian Penal Code, Section 17 of C.L.A. Act, Sections 3, 4 and 5 of Explosive Substance Act.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery of any incriminating article from possession of the petitioner. The name of petitioner has come in the confessional statement of co-accused Sanjay Reddy.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.72969 of 2018(2) dt.06-12-2018 2/2 bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya, in connection withBarachatti P.S. Case No. 92 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
