The petitioner seeks bail in Sadar (Purnea) P.S. Case No. 409 of 2016 registered under Sections 372, 373, 363 & 376 of the Indian Penal Code, Sections 3, 4, 5, 6 & 7 of the Immoral Traffic Act, Section 25 of J.J. Act and Sections 3, 4 and 6 of the POCSO Act.

The petitioner along with his wife is said to have forced the niece of the informant in the illegal business of flesh trade. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. The petitioner has committed no offence and has no concern with the aforesaid occurrence. He has been falsely implicated in this case. The

Patna High Court Cr.Misc. No.73464 of 2018(4) dt.06-02-2019 2/2 petitioner has no concern with the said Shabnam who is said to have forced the victim in the illegal business of flesh trade. The victim in her statement recorded under Section 164 Cr.P.C. has not indicated any complicity of the petitioner in the occurrence rather of one Shabnam claiming petitioner to be the husband of the said Shabnam who is said to have taken the victim from the train by administering her some sedative material and forced her to the illegal business of flesh trade. Petitioner has no criminal antecedent and has been languishing in custody since 08.08.2018.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I-cum-Special Judge, Purnea in connection with Special Case No.71 of 2016 arising out of Sadar P.S. Case No.409 of 2016.
