1. The Writ petition has been filed for the following relief:- That the petitioner abovenamed craves for indulgence of this Hon'ble Court by way of issuance of any appropriate writ preferably in the nature of mandamus directing and commanding the Respondents concerned to pay the petitioner Rs.25,00,000/- the full amount of subsidy which is liable to be paid to the petitioner's firm in lieu of production of vermi compost as the petitioner after being dully licensed
Patna High Court CWJC No.23793 of 2018(4) dt.16-07-2026 2/3 and authorized by the competent authority for production of vermia compost, by taking a loan from the bank, upon the condition that upon production of 3000 Metric Tons (M.T.) in a year the unit shall be liable to get subsidy from the Government of Bihar of Rs.25,00,000/-(Twenty Five Lakhs), but despite fulfilling all criteria and terms and condition as well as the inspections reports in favour of the petitioner, he has not been paid any paise as subsidy, due to which the petitioner is unable to repay his bank loan and he is being penalized whereas his firm is on the brinks of bankruptcy in want of money. And/or to pass such other order/orders for granting any other relief/reliefs for which the petitioner is found entitled to in the facts and circumstances of the case.
2. Heard the Learned counsel for the petitioner as well as the Learned counsel for the respondents.
3. During the course of arguments, it is submitted by learned counsel for the respondents
Patna High Court CWJC No.23793 of 2018(4) dt.16-07-2026 3/3 that the petitioner has received 50% of the subsidy amount during the pendency of the writ petition, and that they are ready to pay the remaining subsidy amount after due verification, if the petitioner makes a fresh application. The Learned counsel for the petitioner also accepted the submissions. Therefore, the petitioner is directed to file a fresh application within a period of 15 days from the date of receipt of a copy of this order. In turn, the respondent authorities shall consider the petitioner's application and pass an appropriate order based on the documents within a period of three months from the date of filing of the application.
4. With the above said observation, the Writ petition is disposed of.
5. Interlocutory Application(s), if any, shall stand disposed of.
