The petitioner seeks bail in Laxmipur P. S. Case No. 50 of 2019 instituted for the offence under Section(s) 25(1b)a/26/35 of the Arms Act. Subsequently, Section 414 of the IPC was added.

It is submitted by the petitioner's counsel that petitioner is in custody since 08.02.2019 on alleged recovery of two live cartridges. The other co-accused, namely, Ram Ratan Kumar from whom one country made loaded pistol and one live cartridge is alleged to have been recovered has already been granted bail by co-ordinate Bench of this Court vide order dated 27.09.2019 passed in Cr. Misc. No. 49812 of 2019. The petitioner is on bail in three other cases pending against him,

Patna High Court CR. MISC. No.78426 of 2019(2) dt.09-12-2019 2/2 details of which has been given in para 3 of the bail petition. The learned APP for the State opposed the prayer for bail. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the J.M.1st Class, Jamui, in connection with Laxmipur P. S. Case No. 50 of 2019, subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
