The petitioner seeks bail in connection with Gaurichak PS Case No.379 of 2025 dated 17.06.2025, instituted for the offence punishable under Sections 309(6) of the Bharatiya Nyaya Sanhita, 2023 in which charge-sheet has been submitted under Sections 310(2), 317(3), 61(2) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the FIR, the Scorpio vehicle of the informant was looted away by unknown miscreants along with named coaccused persons while he visited a site along with the passengers/travellers.

4. Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Only on the basis of confessional statement of Amit Kumar, who disclosed the name

Patna High Court CR. MISC. No.84440 of 2025(2) dt.23-12-2025 2/2 of the petitioner, Bharat Bhusan and Arvind Kumar, the petitioner has been implicated in this case. Learned counsel further submits that the looted Scorpio vehicle was recovered from a vacant land near the house of Bharat Bhushan, who has been granted bail by a co-ordinate Bench of this Court vide order dated 04.12.2025 passed in Cr. Misc. No.60014 of 2025. It is also submitted that nothing has been recovered from the conscious possession of the petitioner. It is further submitted that another co-accused Arvind Kumar has been granted bail yesterday by a co-ordinate Bench of this Court vide Cr. Misc. No.88505 of 2025. Lastly, it is submitted that the petitioner is in custody since 25.06.2025 having no criminal antecedents.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-II, Patna City, Patna, in Gaurichak PS Case No.379 of 2025.

7. The application stands allowed.
