2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 80 and 3(5) of B.N.S.
3. The case of the prosecution is that Pushpa Devi (deceased) was married to one Sonu Paswan in the year 2021. It is alleged that she was subjected to cruelty on account of nonfulfillment of dowry demand and subsequently, she was being killed by her in-laws.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the petitioner is father-in-law of the deceased and from perusal of the order of
Patna High Court CR. MISC. No.87233 of 2025(2) dt.05-01-2026 2/2 the learned trial court, it will transpire that the cause of death of the deceased is asphyxia due to hanging. Learned counsel for the petitioner has further submitted that in this case, police has submitted charge sheet under Section 108 of B.N.S. It has also been submitted that the husband of the deceased has already been granted bail by learned co-ordinate Bench of this Court vide order dated 24.09.2025 passed in Cr. Misc. No. 67031 of 2025. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 23.07.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Chandi P.S. Case No. 204 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M, Ara, Bhojpur.
