The petitioner has prayed for bail in connection with Rail Gaya P.S. Case No. 252 of 2019 registered for the offence punishable under section 30(a) of Bihar Prohibition and Excise Act.

As per allegation in the FIR, 60 litres of mahua liquor is said to have been recovered from beneath the seat where the petitioner was sitting in the train.

It is submitted by learned counsel for the petitioner that no recovery has been made from possession of the petitioner and the allegation that the illicit liquor belongs to the petitioner is false and concocted. It is further stated that he is in custody since 20.06.2019 and has no criminal antecedent.

The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya in connection with Rail Gaya P.S.
