Being aggrieved by judgment and order dated 07.09.2018 passed by learned Single Judge of this Hon'ble Court passed in C.W.J.C. No. 1131 of 2018 dismissing the writ petition appellant/petitioner has preferred this L.P.A. Appellant/petitioner had filed writ petition to re-name upgraded middle school Pararee, Bihta (Patna) in the name of

Patna High Court L.P.A No.1650 of 2018 dt.30-01-2021 2/2 his grandfather Balgovind Singh as he had donated the land in the year 1938 by a registered deed of agreement executed in favour of District Board, Patna in which school was running under the control of District Board, Patna, as Primary School, Pararee since 1948 and no objection was ever raised with respect to nomenclature of said school at any point of time. The school was taken over by Bihar non-government elementary schools (Taking Over of Control) Act, 1976 w.e.f. 01.01.1971 and thereafter it was upgraded into a middle school in the year 2004.

Writ court dismissed the writ petition on the ground of delay and latches as the issue to re-name the school was raised after 65-70 years of its establishment. This Court does not find any infirmity or error in the order passed by the learned Single Judge, accordingly, present L.P.A. is dismissed.
