====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 31-01-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 306, 504, 506, 34 of the Indian Penal Code.

3. The informant alleged that due to abusing by the accused persons and other villagers saying that his wife has illicit relations with the petitioner, the informant's wife became extremely sad and depressed, as a result, she consumed the poisonous substance and during the treatment, she died.

4. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has committed no offence. No such occurrence as alleged has ever taken place.

The allegation levelled against the petitioner is totally false and based on concocted facts. Nothing specific has been attributed against the petitioner. He has no role in the alleged occurrence. It is further submitted that petitioner is a young boy and a student. There is no cogent material available on record to show his complicity in the present case. Similarly situated co-accused have been enlarged on bail by this court vide order dated 22.08.2023 passed in Cr. Misc. No. 44250 of 2023. Learned counsel further submits that petitioner has no criminal antecedent as mentioned in para-3 of this application.

5. Learned APP for the State opposes the prayer for bail.

6. Having regard to the facts and circumstances of the case, since there is no specific overt act against the petitioner and similarly situated co-accused have been enlarged on bail, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Nathnagar (Madhusudanpur) P.S. Case No. 370 of 2022,
