The petitioner seeks bail in Tekari P.S. Case No.382 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act and under Sections 3, 5, 13 of Mahua Flower Act, 2006.

Learned counsel for the petitioner submits that nothing has been recovered from possession of the petitioner. The petitioner had come to the house of his sister and on mere suspicion, the petitioner was apprehended. From the house of Vinay Choudhary, 28 litres of country made liquor made of Mahua was recovered.

Taking into consideration the facts aforesaid and the fact that the petitioner is in jail since 24.10.2019, the petitioner,

Patna High Court CR. MISC. No.78214 of 2019(2) dt.10-01-2020 2/2 above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge, Gaya in connection with Tekari P.S. Case No.382 of 2019.
