2. The present petition has been preferred for the grant of following relief(s):

"against highly illegal, wrongful, arbitrary and motivated action on the part of the respondent 2nd set i.e. present LRDC, Sasaram, Rohtas, by which even though despite knowledge that already for same relief land dispute Case

Patna High Court CWJC No.23515 of 2018(2) dt.17-11-2025 2/3 No. 179/2013-14 filed by the respondent 3rd set Yaduwansi Devi was rejected by the DCLR by order dated 10.03.2014 contained in annexure-3 and despite knowledge that for the property in dispute T.S. No. 395/1995 is going on in the court of Learned Sub-Judge-II, Sasaram, Rohtas and other cases bearing T.S. No.3/2011 and T.S. No. 4/2015 for same property are also pending before Learned Civil Court, Sasaram for the land in dispute but the respondents 2nd set deliberately due to obvious reasons has initiated proceeding under Bihar Land Dispute Resolution Act and has directed the Circle Officer to measure the land despite objection raised by petitioner, in complete violation of the section 4(2), 4(5), and section 10(2) of the Bihar Land Dispute Resolution Act, 2009."

3. After some argument, learned counsel for the petitioner submits that he shall be challenging the said order of the learned DCLR in land dispute case no. 179 of 2013-14 before and appropriate authority.

4. Learned State counsel has no objection.

5. In that background, the writ petition is disposed of allowing the petitioner to to approach the appropriate authority to challenge the said order.

6. If such petition is preferred in next four weeks, the concerned authority shall see to it that the matter was pending before this Court since last seven years while dealing petition. (Rajiv Roy, J) vinayak/- U
