2. The petitioners apprehend arrest in connection with Roh PS Case No.258 of 2024 dated 28.08.2024, instituted under Sections 126(2), 115, 118(1), 109(1), 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. The allegation against the petitioners is that they assaulted the informant, his brother and uncle by means of iron rod, lathi etc. when they were going in the field due to which they sustained injuries on the head, leg etc.

4. Learned counsel for the petitioners submits that there is no specific allegation against the petitioners, rather, there is general and omnibus allegation. It is also submitted that the FIR has been lodged after eleven days of the occurrence. The date of occurrence is 17.08.2024, but the FIR has been lodged on 28.08.2024. Further submission is that for the same occurrence petitioner no.2 has also lodged FIR against the informant and others vide Roh PS Case No.247 of 2024 dated 17.08.2024. Further submission is that the doctor has found simple injury on the person of the informant. Further the doctor has opined the injury on the person of Chandramauli Singh (uncle of the informant) to be grievous in nature and there is no injury report of injured Rajeev available in the case diary. There is land dispute between the parties.
It is also submitted that petitioner no.1 and uncle of the informant are the full brothers and petitioner nos.2 to 4 are cousin of the informant. Lastly, it is submitted that petitioner nos. 2 to 4 have no criminal antecedents, whereas, petitioner no.1 has one criminal case against him.
5. Learned APP has opposed the prayer for bail.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in

No.89269 of 2024(3) dt.19-04-2025 3/3 the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Nawadah, in Roh PS Case No.258 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
7. The application stands allowed.
