This application, for grant of anticipatory bail, arises out of Complaint Case No. 1703 (C) of 2017, disclosing offences under Section 498A of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act, 1961. The dispute between the parties was pertaining to matrimonial discord. However, on the direction of this Court, the parties were referred for mediation before the District Mediation Centre, Araria, in which Mediation Case No. 21 of 2019 was registered. Both the parties, i.e. the petitioner and the Opposite Party No. 2 appeared before the learned Mediator, who
Patna High Court CR. MISC. No.73423 of 2018(5) dt.01-07-2019 2/2 has submitted his report, dated 22.05.2019. From perusal of the said report, it appears that the parties have started living together and have settled their dispute cordially. In view of the compromise arrived at between the parties, this application is allowed.
Let the petitioner, Md. Quaisar, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Araria, in connection with Complaint Case No. 1703 (C) of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
