The petitioner seeks bail in a case registered under Sections 376, 323, 511 of the Indian Penal Code. Allegedly, the petitioner having entered house of the informant committed rape upon her.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 21-08-2019. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. There is no medical examination report to support the allegation made in the FIR. The petitioner has been made accused in this case due to village politics.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Ist, Munger in connection with Sessions Trial No. 277 of 2019 arising out of Asarganj P.S. Case No. 96 of 2018.
