JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 13-12-2019 The petitioner, who is the son of the late employee, has approached this Court for a direction to the respondents to make available to him the death-cum-post retiral benefits of his late father, which even though has been sanctioned, has not been paid.

There does not appear to be any justifiable reason for withholding the payment of death-cum- post retiral dues of the father of the petitioner.

Several representations of the petitioner before the concerned authorities have yielded no result. Hence the present writ petition.

Patna High Court CWJC No.25086 of 2019 dt.13-12-2019 2/2 The petitioner under the aforesaid circumstances is directed to file a representation before the Senior Superintendent of Police, Gaya (respondent no. 5) within a period of four weeks, detailing the amount which is required to be paid, who on receipt of such representation shall have the facts verified, ascertain the payability and if the claim of the petitioner is found to be tenable, necessary orders shall be passed within a further period of four weeks and within the aforesaid period provision would be made for payment of such dues to the petitioner. With the aforesaid direction/observation, the writ petition stands disposed of.
