====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 09-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. In the present case, the petitioner seeks bail in connection with Parashbigha P.S. Case No. 261 of 2025, registered for the offences under 126(2), 115(2), 109(1), 303(2), 3(5),& 61(2) of the BNS.

3. As per the prosecution case, the petitioner and his co-accused son assaulted the informant with spade and sickle causing a number of injuries to him. It is further alleged that on saying of co-accused Subhash Sharma the petitioner and the coaccused assaulted the informant.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. There is case and counter case

Patna High Court CR. MISC. No.83974 of 2025(2) dt.09-12-2025 2/3 and for the occurrence of same date the petitioner instituted Parashbigha P.S. Case No. 264 of 2025 under Sections 126(2), 115(2), 303(2), 351(2), 352 of the BNS. The prosecution story is not believable as co-accused Subhash Sharma is the own brother of the informant. Learned counsel further submits that some scuffle took place between the parties and taking advantage of this fact, the informant lodged the present case. The injury report shows lacerated wound on the informant but the allegation is of assault by spade and sickle but no sharp cut injury has been found. The petitioner is in custody since 08.10.2025 and he has one criminal antecedent.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the case and counter case between the parties, absence of injury attributed to the petitioner and also considering his period of custody, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st, Jehanabad/concerned court, in connection with Parashbigha P.S. Case No. 261 of 2025, subject

Patna High Court CR. MISC. No.83974 of 2025(2) dt.09-12-2025 3/3 to the condition laid down under Section 480(3) of the BNSS and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
