The petitioner is in custody in connection with Roushanganj P.S. Case No. 81 of 2014 for the offence under Sections 147, 148, 149, 120 (B), 121 (A), 124 (A), 323, 325, 427, 385, 386, 395 of the Indian Penal Code and 3/ 4 Explosive Substance Act, 13, 16, 18, 20 U.A.P. Act and 17 C.L.A Act. Learned counsel for the petitioner submits that petitioner is in custody since 25.7.2018. He further submits that in the instant case only allegation against this petitioner is that he is associated with extremist and help in collecting 'Chanda' and article to the extremist.
In this case, case-diary was called for. Learned APP appearing on behalf of the State with reference to case diary
Patna High Court Cr.Misc. No.75797 of 2018(3) dt.29-01-2019 2/2 would submit that he provides assistance to the extremist. Considering the fact that in the instant case there is no specific allegation of commission of any offence against this petitioner, and he is in custody since 25.7.2018 the Court is inclined to enlarge the petitioner on bail, let the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Chief Judicial Magistrate, C.J.M. Gaya in connection with Roushanganj P.S. Case No. 81 of 2014, subject to the condition that one of the bailors should be the elected representative of the local body.
