2. The petitioner is in custody since 26.06.2023 in connection with Sour Bazar P.S. Case No. 142/2023 registered for the offence punishable under Sections 341/307/504/506/ 379/34 of the Indian Penal Code and 27 of the Arms Act.

3. As per the prosecution case, the petitioner is accused of assaulting the victim causing grievous injury.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that both the parties are next door neighbours and the occurrence took place on account of land dispute between them.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, let the petitioner above named be released on bail after framing of charge, if charge has not already been framed, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge III, Saharsa in connection with Sour Bazar P.S. Case No. 142/2023.

7. The petitioner is directed to mark his attendance in Sour Bazar on 1st Sunday and 4th Sunday of every month failure to do so, will result in cancellation of bail bond of the petitioner. (Sandeep Kumar, J) Saif/- U T
