2. The petitioner apprehends his arrest in connection with Sachiwalaya P.S. Case No. 111 of 2023, registered for the offences punishable under Section 409 of IPC.

3. According to the prosecution case, the petitioner was posted as Assistant-cum-Treasurer, New Capital Circle, Patna and at present, he is posted as Assistant, Bankipur, Circle Patna Nagar Nigam. According to audit report, the petitioner collected Rs. 25,73,779 for property tax and solid waste management fee, but he did not deposit it and defalcated that money.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. The petitioner has deposited the entire amount collected by him in the treasury through cheque number 118109, and in this respect, he has sent a letter to the Municipal Corporation, Patna. The letter is annexed as Annexure- P/3 at page number 17 and 18 of this petition.

5. In order to verify the authenticity of the submission of the learned counsel for the petitioner, a report was called for from the Municipal Commissioner, Patna but no report has been received. A reminder was also sent, but still no report has been received.

6. It appears that the petitioner has deposited the entire amount.

7. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned JMFC, at Patna in connection with Sachiwalaya P.S. Case No. 111 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C.

8. Let a copy of this order be communicated to the Municipal Commissioner, Patna, Bihar as well as the Advocate General.
