The petitioner is apprehending his arrest in connection with Bihta P.S.Case No.822 of 2017 dated 17.10.2017 , registered for offences punishable under Sections ----379 and 120B of the Indian Penal Code.
Allegation against the petitioner as per FIR is that some Poklene machine were seized by the police and kept in the custody of the Chaukidar and one of the machine was removed from there . The petitioner being owner of the Poklane Machine is alleged to have omitted such offence.
Submission of the learned counsel for the petitioner is that the whole allegation is false and concocted. He is a man of means and ready to abide by any condition imposed upon him. Heard learned A.P.P. also.

No.74165 of 2018(4) dt.11-04-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-1, Danapur, Patna in connection with Bihta P.S.Case No.822 of 2017 dated 17.10.2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid observation, this application is allowed.
