2. The petitioner seeks bail in a case registered for the offence under Sections 363, 366A, 34 of the Indian Penal Code.

3. As per F.I.R., this petitioner and two unknown persons kidnapped the minor daughter of the informant.

4. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case due to previous enmity. There is no eye-witness of the occurrence and only on suspicion, he has been made accused. It is further submitted that the victim, in her statement recorded under Section 164 Cr.P.C., has not supported the prosecution case and stated that she was in love with this petitioner for the last two years and as such, on 27.06.2023, without informing anyone, she went with this petitioner to Kanpur and solemnised marriage with him. The

Patna High Court CR. MISC. No.687 of 2024(3) dt.21-03-2024 2/2 doctor has assessed the age of victim, as 20 years. In this case, chargesheet has already been submitted. Petitioner has got clean antecedent and is in custody since 18.07.2023.

5. However, learned A.P.P. for the State opposed the bail petition.

6. Considering the aforesaid facts and circumstances as well as statement of the victim recorded under Section 164 Cr.P.C., let the above named petitioner be released on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge 6th cum Special Judge POCSO, Vaishali at Hajipur in connection with Rajapakar P.S. Case No. 237 of 2023.
