2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 309(6) and 3(5) of the BNS, 2023.

3. The case of the prosecution is that while the informant was going on his bike, two unknown miscreants intercepted him, took away the key of his bike and one of them stabbed with knife, after that, they took away his bike. The case was filed against unknown miscreants.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. During investigation, one Sonu has given his confessional statement and in his

He also submits that nothing was recovered from the possession of this petitioner rather the recovery has been made from the possession of one co-accused namely, Md. Haider. It is further submitted that the petitioner is languishing in judicial custody since 05.10.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail and submits that the petitioner is having criminal antecedent of three cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kalyanpur P.S. Case No. 206 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur.
