2. The petitioner is apprehending his arrest in a case in connection with Bettiah Town P.S. Case No. 364 of 2023 dated 17.05.2023 registered for the offence/s punishable u/s 379 of the Indian Penal Code.

3. As per the prosecution case, unknown miscreant is alleged to have stolen the motorcycle of the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has sprung up in the confessional statement of the co-accused Arman Khan. Nothing has been recovered from the

Patna High Court CR. MISC. No.2811 of 2024(3) dt.19-02-2024 2/2 conscious possession of the petitioner. The petitioner has no criminal antecedent as stated in para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the anticipatory bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Bettiah, West Champaran in connection with Bettiah Town P.S. Case No. 364 of 2023, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.

7. The application stands allowed.
