2. The petitioner has prayed for bail in connection with Sohsarai P.S. Case No.171 of 2024 registered for the offence punishable under Sections 103, 3(5) of BNS, 2023 and Section 27 of the Arms Act.

3. The case of the prosecution is that on 15.07.2024 when informant's wife Sulekha Devi was returning to the house with his sister Saraswati Kumari after filling water from the well, Dharmendra Chaudhary and Sagar Chaudhary surrounded his wife on the way and shot her and fled away. It is further alleged that father and the people of the locality came on hearing the sound of the bullet and found his wife lying unconscious and covered in blood. From there she went to Sadar Hospital and found his wife dead.

4. Learned counsel appearing on behalf of the petitioner submits that from perusal of the postmortem report it will transpired that deceased has received only one bullet injury.

5. The learned counsel for the State has submitted that from perusal of the FIR it is clear that Sarswati Devi, the sisterin-law of the deceased is an eye witnesses. She has stated that Dharmendra Chaudhary fired at her sister-in-law. She has further stated that Sagar Chaudhary was also there and that he had given the gun to Dharmendra Chaudhary who had fired. It transpired that there is role of this petitioner in the alleged occurrence. Petitioner is in custody since 20.07.2024.

6. Considering the above facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. However, the petitioner is at liberty to renew his prayer for bail after six months, if so advised.
