JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Kinjar P.S. Case No. 20 of 2018 for the offence under Sections 304(B), 201/34 of the Indian Penal Code.
Considering the fact that the police after investigation submitted charge-sheet under Section 302 read with Section 201 of the Indian Penal Code and, as such, the plea as to nonapplicability of Section 304B of the I.P.C. is not attracted in this case, the Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for grant of bail is rejected. However, if the trial is not concluded within a period of nine months, the petitioner may renew his prayer for bail.
