2. The petitioner seeks bail in connection with Ahiyapur P.S. Case No. 8 of 2019 registered for the offence under Section 304/34 of the Indian Penal Code.

3. As per the prosecution case, the allegation against the petitioner and other accused persons is that they have killed the husband of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case and he has committed no offence as has been alleged by the prosecution side. He further submits that other co-accused

Patna High Court CR. MISC. No.3412 of 2024(2) dt.31-01-2024 2/2 persons namely Vikash Rai and Bindeshwar Rai have already been granted bail by this Court vide order dated 02.08.2023 passed in Cr. Misc. No. 31993 of 2023.

5. It is also submitted by the learned counsel for the petitioner that the petitioner is an old man aged about 70 years and he is in jail since 14.09.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts and also considering the age of the petitioner, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Muzaffarpur in connection with Ahiyapur P.S. Case No. 08 of 2019.
