JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-03-2020 The petitioner seeks bail in connection with Laheria Sarai P.S. Case No. 400 of 2018 dated 09.08.2018 instituted for the offences under Sections 323, 341, 324, 302, 307 and 34 of the Indian Penal Code.

The petitioner along with two other named accused persons and three to four unnamed are alleged to have stabbed the deceased to death. The informant of this case is the father of the deceased who received such information through one Abhishek Kumar Jha whose house the deceased had visited. Aforesaid Abhishek Kumar Jha has given his statement before the police that at the relevant time, only his servant viz. Ajay Kumar Singh was available in his house, who had informed him that the named accused persons including

In the meantime, when the miscreants saw the deceased, he too was attacked which led to his death. In the aforesaid context, the name of the petitioner was taken by the servant of aforesaid Abhishek Kumar Jha but without disclosing the parentage and any further identity of the petitioner. Considering these aspects of the matter, two other named accused persons have been granted bail by different benches of this Court.

Regard being had to the aforesaid facts as also that apart from this case, the petitioner has been made accused in one case in which he is on bail, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Laheria Sarai P.S. Case No. 400 of 2018.
