ANJANA MISHRA ORAL ORDER 05-12-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Konch P.S. Case No.187 of 2019 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 337, 326, 379, 504 of the I.P.C. and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the entire allegations are false and concocted and the petitioner is mere a businessman and running a grocery shop in the village to maintain his family. It is further submitted that there is general and omnibus allegation of having abused the informant's nephew and grandson and the story of snatching of golden chain
Patna High Court CR. MISC. No.79778 of 2019(2) dt.05-12-2019 2/2 is but a super-addition to make the charge graver. Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Gaya, in connection with Konch P.S. Case No.187 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
