The petitioner seeks bail in Rampur P.S.Case No.154 of 2014 registered under Sections 302, 201/34 of the I.P.C. Accusation as per the F.I.R. is that in course of patrolling duty the informant being Home Guard received information about some occurrence thereafter he along with police party reached near lavatory in the play ground of the College and found a dead body of male lying in the hodge of lavatory. The petitioner is not named in the F.I.R. Learned Counsel for the petitioner submits that in course of investigation recovered dead body was identified on the basis of its cloth by Nitu Devi as of her husband who disclosed the name of the petitioner and one Sanjay as from

Patna High Court Cr.Misc. No.71250 of 2018(2) dt.03-12-2018 2/2 before dispute regarding money was going on between her husband and the petitioner and one Sanjay and except that nothing has been attributed against the petitioner. He is in custody since 28.09.2018 having no criminal antecedent. Learned A.P.P. opposed the prayer for bail of the petitioner.

Considering the facts and circumstances of the case, let the petitiioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Gaya, in Rampur P.S.Case No.154/14.
