JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-02-2020 This modification application has been filed for modification of order dated 11.09.2019 passed in Cr. Misc. No. 57347 of 2019, by which, the petitioner and others have been granted the privilege of anticipatory bail and they were directed to surrender in the court below within two weeks. Submission of learned counsel for the petitioner is that as the petitioner was suffering from Dengue, he could not surrender within the time directed by this Court and thus prayed for modification or order dated 11.09.2019 passed in Cr. Misc. No. 57347 of 2019 and for extension of time.

Having heard both sides, considering the fact that the order has been passed on 11.09.2019, whereas, this application

Patna High Court CR. MISC. No.54 of 2020(3) dt.26-02-2020 2/2 has been filed in the November 2019. Hence, I am not inclined to interfere with the order dated 11.09.2019 passed in Cr. Misc. No. 57347 of 2019. The petitioner has to surrender before the court below and pray for regular bail, which will be considered by the court below on its own merit, without being prejudiced by this order.

Accordingly, this modification application is dismissed.
