JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2019 This application, for grant of anticipatory bail, arises out of Araria (R.S.) P.S. Case No. 821/19, disclosing offences under Sections 341, 323, 325, 307, 447, 380, 354, 504, 506/34 of the Indian Penal Code.

Allegation against the petitioner is of assault to the mother of informant by means of bamboo causing injury to her and also taken away Rs. 50,000/-.

Submission of learned counsel for the petitioner is that the real fact is that the mobile phone of one of the accused by stolen by the son of the informant and when they went to the house of informant and asked to return the mobile, in which,

Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Araria (R.S.) P.S. Case No. 821/19 , subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
