In this case, the petitioners are apprehending their arrest in connection with Jokihat P.S. Case No. 310 of 2018 registered for offences under sections 406, 420/34 of the Indian Penal Code and Section 45 of the Co-operative Act, 1935. Learned counsel for the petitioners submits that the petitioners are enjoying the privilege of getting benefit of Section 41(1) of the Cr.P.C. i.e. police bail. In that view of the matter, let the petitioners should surrender before the court below within a period of four weeks
Patna High Court CR. MISC. No.78980 of 2019(2) dt.11-12-2019 2/2 from today and pray for bail and if the court below would find that the petitioners have not violated the terms and conditions of the police bail, the court below will take a decision in terms of the judgment passed in the case of Mahendra Prasad Singh Vs. State of Bihar reported in 2004 (3) PLJR 491. With the aforementioned observation, this application is disposed of.
