JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Gaya Kotwali P.S. Case No. 226 of 2018, registered for the offences punishable under Sections 363, 365, 34 and later on Sections 302, 201 of the Indian Penal Code were added.

Allegation against the petitioner, who happens to be father-in-law of the deceased, is that he in collusion with the husband of the deceased has killed the deceased and concealed her dead body and later on it appears that on the basis of confessional statement of husband of deceased the dead body was recovered and petitioner has also been named and involvement of the petitioner has transpired in the confessional statement.

Submission of learned counsel for the petitioner is

Patna High Court CR. MISC. No.74474 of 2018(3) dt.12-04-2019 2/2 that he has falsely been implicated in this case and he is fatherin-law. Heard learned APP also, who has opposed the prayer for anticipatory bail on the ground that process under Section 82 Cr.P.C. has already been issued against him and there is also allegation against him of killing the deceased. Having heard both sides and in the facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner.

Hence, this application is dismissed.
