The petitioners apprehend their arrest in Aurangabad Town P.S. Case No. 102/2018 registered for the offence under Sections 147, 148, 149, 337, 323, 435, 436, 427, 307, 332, 333, 353, 153A, 295A, 379 and 120B of the Indian Penal Code. As per FIR, petitioners are named accused and there is allegation that petitioners and other co-accused tried to disrupt the communal harmony, pelted stones on the procession of Ram Navmi.
Learned counsel for the petitioners submits that no specific allegation has been attributed against these petitioners. Petitioners have falsely been implicated in this case. He further submits that similarly situated co-accused persons have already
Patna High Court CR. MISC. No.83687 of 2019(4) dt.04-03-2020 2/2 granted anticipatory bail by the coordinate Bench of this Court vide order date 25.10.2019 passed in Cr. Misc. 68564 of 2019. Considering the aforesaid facts and circumstances as well as nature of accusation, in the event their arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M, Aurangabad in connection with Aurangabad Town P.S. Case No. 102/2018, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
