====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 18-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Ahiyapur P.S. Case No. 1036 of 2017 instituted for the offence under Section 302/34 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner has clean antecedent. He is not named in the written report. In the written report it is alleged that one Kanhai Thakur has given threat to father-in-law of the informant that he will kill his son Chandan Kumar. It is further alleged that after 15 minutes, father-in-law of the informant got information that his son is lying seriously injured on the way to Zero Mile near Lilawati Hospital and he was taken to SKMCH for treatment. The informant reached Lilawati Hospital and found his brotherin-law seriously injured and unconscious. He was taken to I.T.

Patna High Court Cr.Misc. No.75412 of 2018(2) dt.18-12-2018 2/2 Memorial Hospital from where he was referred to PMCH for better treatment, but he died during course of treatment. Counsel for the petitioner submits that petitioner has been implicated in the instant case merely on suspicion by the police during investigation. He is in custody since 18.9.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 1036 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
