The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 337, 323, 435, 436, 427, 307, 332, 333, 353, 153A, 295A, 379 and 120B of the Indian Penal Code.
It is submitted by learned counsel for the petitioners that co-accused Gaurav Chauhan having identical allegation has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 28.06.2018 passed in Cr.Misc.No.35295 of 2018.
Learned counsel for the State does not controvert the
Patna High Court CR. MISC. No.79123 of 2019(2) dt.04-12-2019 2/2 submission made by the learned counsel for the petitioners. Considering the reasons assigned in the aforesaid order dated 28.06.2018 whereby co-accused Gaurav Chauhan has already been granted pre-arrest bail, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender in the court below within a period of thirty days from the date of receipt of the order, on furnishing bail bond of Rs.20,000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Aurangabad Town P.S.Case No.101 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
