2. The petitioner seeks bail in connection with Charpokhari P.S. Case No. 24 of 2023 registered for the offence punishable under Sections 304(B) and 498(A) of the Indian Penal Code.

3. As per the prosecution case, the accused persons have killed the deceased.

4. Learned counsel for the petitioner has submitted that it was an old marriage and because the petitioner and the deceased had no child, the deceased has committed suicide. He also submits that from perusal of the postmortem report, it will appear that there is no ante-mortem injury except the ligature mark which supports the case of the petitioner that the deceased

5. Learned APP has opposed the prayer for bail.

6. Considering the post-mortem report and the period of custody, this application is allowed.

7. Let the petitioner, above named, be released on bail, after framing of charge if the charge has not already been framed, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Bhojpur at Ara in connection with Charpokhari P.S. Case No. 24 of 2023, subject to the condition that the petitioner will co-operate in the trial and he will appear personally or through his Advocate in the trial.
