2. The petitioner seeks bail in connection with Sadar (Bhalpatti O.P.) P.S. Case No. 553 of 2023 dated 09.08.2023 instituted for the offences under Section 379 of the Indian Penal Code.
3. The prosecution case is to the effect that the informant has given fardbeyan that his tractor was taken away by three unknown persons and despite his hectic search the same could not be recovered.
4. It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR and his name has surfaced in confessional statement of co-accused Imran Khan @
Patna High Court CR. MISC. No.88666 of 2024(3) dt.07-05-2025 2/3 Kalu. It is further submitted that the petitioner has no concern whatsoever with the other co-accused persons and he was approached by them to purchase the tractor, hence, the same was recovered from his possession. It is also submitted by learned counsel for the petitioner that the petitioner carries one criminal case which is pending against him, however, he is in custody since 01.06.2024.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioner.

Considering the aforesaid submissions of respective counsels and taking into account the fact that the petitioner is in custody since 01.06.2024, the petitioner above named, is directed to be released on bail on furnishing bail-bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Sadar (Bhalpatti O.P.) P.S. Case No. 553 of 2023, subject to the the following conditions:- (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the
Patna High Court CR. MISC. No.88666 of 2024(3) dt.07-05-2025 3/3 Court below, if so required by the learned Trial Court.
(iii) In case of absence on two consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be canceled by the Court concerned.
