JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 17-01-2019 This is an appeal under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the refusal of prayer of anticipatory bail dated 12.10.2018 passed by the learned Special Judge SC/ST, Gaya in Fatehpur P.S.Case No. 55 of 2018 registered under Sections 147, 149, 308, 323, 354, 427, 436 and 506 of the Indian penal Code and Sections 3(i)(r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 . Allegation against the appellant as well as other accused persons, is that during Holika Dahan, they threw a burning stick on the house of the informant and when she tried to raised alarm, they started to outrage her modesty. When family members of the informant came, accused persons also assaulted

Submission of learned counsel for the appellants is that there is false implication and nothing specific has been attributed against the appellant.

Having heard both sides and in view of the allegation, I am not inclined to grant privilege of anticipatory bail to the appellant. However, he is directed to surrender and make prayer for regular bail which shall be considered on its own merit without being prejudiced by this order and, if possible, dispose it on the same day.
