2. The petitioners have preferred this application for grant of regular bail in connection with Lakhisarai (Amhara) P.S. Case No. 969 of 2023 dated 13.012.2023 registered for the offences punishable under sections 379 and 420 of the Indian Penal Code.

3. As per the prosecution case, the informant who happens to be the Deputy Branch Manager of Main Branch of State Bank of India at Lakhisarai which has got a Customer Service Point situated at Amhara in favour of Save Solution

2/4 Private Limited being operated by one Suraj Kumar Saw (petitioner no.1) Code No. IA74G836C where his brother Neeraj Kumar (petitioner no.2) is the Co-Manager and the coaccused Bharat Kumar also used to manage the affair of the C.S.P. and it has been learned by the informant and the concerned Bank that all the three persons engaged in C.S.P. have misappropriated crores of rupees from the account of five thousand to six thousand customers and they have shut down the C.S.P. and run away.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioners. It is further submitted that the petitioners are not involved in the alleged offence and they have not misappropriated any amount of Save Solution Ltd. Company and there is no specific allegation against the petitioners. The petitioners have one criminal antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 12.06.2024. The co-accused has been granted regular bail by a Co-ordinate Bench of this Court vide order dated 01.03.2024 passed in Cr. Misc. No. 13978 of 2024.

5. Learned A.P.P. for the State has vehemently

3/4 opposed the bail petition of the petitioners by submitting that as per para-22 of the case diary, the confessional statement of the co-accused, Bharat Kumar which reflects that he was an employee of Suraj Kumar (petitioner no.1) and there was financial irregularity being committed by the Customer Service Point by different way and the co-accused Bittu Kumar was also involved in the same where all the accused persons were engaged in the said transaction and cheated the customers.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Lakhisarai (Amhara) P.S. Case No. 969 of 2023, with the following conditions:- (i) That the petitioners are directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioners will liable to be canceled.

(ii) The petitioners are directed to co-operate the trial
