The petitioner apprehends his arrest in connection with Sadar P.S. Case No. 829 of 2018 registered under Section 30(a) of the Bihar Excise Act.

The accusation is that on receiving secret information about keeping the illicit liquor in the market of Krishna Mohan Patel situated near Bhagwanpur, the informant along with other police personnel reached there and started to search. On search of Thela in damaged condition, 15 bottles each containing 180 ml Indian made foreign liquor were recovered. When the informant entered in the market of the

Patna High Court CR. MISC. No.78607 of 2019(2) dt.03-12-2019 2/2 petitioner and started to search the room then three bottles each containing 750 ml and three bottles each containing 180 ml Indian made foreign liquor were recovered.

Learned counsel for the petitioner submits that while the shop which is said to be searched was in the market of the petitioner but the said shop was let out by the petitioner for printing purpose but the petitioner being the landlord of the market has falsely been implicated in this case mere on suspicion.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur, in connection with Sadar P.S. Case No. 829 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
