JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-03-2019 This is an application for grant of anticipatory bail in connection with Beldaur P.S. Case No. 179 of 2018, disclosing offences under Sections 406, 409 and 420 of the Indian Penal Code.
Allegation against the petitioner is that on physical verification in the godown of B.S.F.C., Beldaur, it was detected that 428 bags of rice were found along with some other articles and the petitioner has misappropriated Rs.5,78,396/-. Submission of learned counsel for the petitioner is that he has already deposited Rs.5,78,396/- by challan and other modes to the B.S.F.C., Khagaria.
Heard learned A.P.P. as well as learned counsel for the
Patna High Court CR. MISC. No.3529 of 2019(3) dt.11-03-2019 2/2 B.S.F.C. also.
Having heard both sides, in view of the facts and circumstances of the case as stated above, this application is disposed of with a direction to the petitioner to surrender before the learned court below within a period of six weeks and produce the challan and other papers showing the payment of the whole amount, which will be verified by the learned court below and once the learned court below is satisfied, he shall release the petitioner on bail on furnishing bail bonds of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to his own satisfaction. It is needless to say that during verification of papers, if it takes some times, the learned court below shall release the petitioner on provisional bail to his own satisfaction.
