2. The petitioner seeks bail in connection with Bettiah (Muffasil) P.S. Case No. 536 of 2023 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.
3. The petitioner is the brother of the deceased. The deceased was killed by the son of the petitioner namely, Prince Kumar. The petitioner is the order giver. He is in jail since 20.09.2023.
4. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.
5. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties,
Patna High Court CR. MISC. No.3142 of 2024(3) dt.09-04-2024 2/2 let the petitioner, above named, be released on bail, after framing of charge if charge has not already been framed, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran in connection with Bettiah (Muffasil) P.S. Case No. 536 of 2023, subject to the condition that the he will appear on each and every date personally. Any default in appearance will result in automatic cancellation of the bail bonds of the petitioner.
